Is your car or truck a LEMON? If it has been repaired three or more times for the same defect, or has spent 30 days in the repair shop during the manufacturer's original warranty period, it may be a "lemon" qualifying you for a refund, new replacement vehicle or cash settlement. What Type of Defects Qualify under the California Lemon Law?
Any defect, malfunction, or failure to conform to the written warranty AND substantially impairs the use, value, or safety of the vehicle to the consumer.
If the dealership is unable to repair the vehicle after a reasonable number of attempts the manufacturer must promptly either replace or repurchase the vehicle. The consumer is free to elect the repurchase option in lieu of replacement. In no event may the manufacturer require a consumer to accept a replacement vehicle.
